Taksicim Mobile Technology (“TAKSİCİM”) is a technology platform (“Application”) that brings taxi drivers (“Drivers”) and customers (“Customers”) together.
1. APPLICATION AND MEMBERSHIP
1.1. The Customer may start using the Application by downloading the Application, completing the required registration fields, verifying their mobile phone number, and entering their password in accordance with these Terms of Use (“Terms”).
1.2. The Customer agrees that all information provided during the application is always complete, accurate, and up-to-date. The Customer may update their personal information through the Application at any time. The exceptions set forth in 4.2 are reserved.
1.3. Use of the Application is free of charge.
2. APPLICATION USE
2.1. After registering and opening the Application, the Customer clicks the taxi call button. The Application will direct the closest taxi to their location. If the Driver accepts the call, the Driver and vehicle information will be sent to the Customer.
2.2. TAKSİCİM makes every effort to ensure that the information provided regarding the assigned vehicle (estimated arrival time, distance from the vehicle to the Customer, etc.) is accurate. However, it cannot be held responsible for any failure to fully reflect the information.
2.3. After this stage, the Customer may cancel the trip by pressing the cancel button on the screen. Otherwise, the Customer agrees to wait for and board the assigned taxi. The Customer may cancel the trip by pressing the cancel button free of charge within 2 minutes of the Driver being assigned. If the Driver cancels after 2 minutes, the Customer:
• will be warned for the first unjustified cancellation and will be informed that they will be charged for subsequent unjustified cancellations; and for subsequent unjustified cancellations after the first cancellation, the Customer will be charged 5 TL per cancellation.
2.4. To make repeat calls after the first unjustified cancellation, the Customer must add the Online Payment System to the App. The fees specified in this Article will be collected through the Online Payment System. The e-invoice for the cancellation fee will be sent to the passenger’s email address.
2.5. If the driver is kept waiting at the destination for more than 2 minutes, they may cancel the call. In this case, the Customer will be charged a 5 TL cancellation fee. This cancellation fee will be collected through the Online Payment System, and the Customer must first pay the cancellation fee through the Online Payment System before being able to make a call through the App. The e-invoice for the cancellation fee will be sent to the passenger’s email address.
2.6. If the driver does not arrive at the destination or does not approach the designated location, the Customer will not be charged a cancellation fee. Furthermore, no cancellation fee will be charged if the Customer cancels their trip more than 2 minutes after the estimated arrival time.
2.7. If the Customer does not wait for the arriving taxi or does not board the taxi without a valid reason, TAKSİCİM reserves the right to remove the Customer from the App.
2.8. The Customer is responsible for paying the full cost of the taxi trip they booked using the App.
2.9. The Customer can call a Yellow or Turquoise taxi through the App. The fare varies depending on the selected taxi type (Yellow/Turquoise). Turquoise taxis operate with a 15% difference in the taximeter rates set by the Istanbul Metropolitan Municipality (IMM).
2.10. The Customer can call a taxi by entering a destination through the App. When the destination is selected, the fare and arrival time calculated through the App are estimated. The estimated fare does not include bridge and highway tolls. The fare and arrival time may vary depending on the route chosen by the Driver or Customer and/or traffic conditions. TAKSİCİM cannot be held responsible for any fare/time differences that may occur.
2.11. For trips made through the App, the Customer is also responsible for paying road usage costs, such as bridges, roads, and highways, as clearly specified in the relevant legislation, in addition to the fare printed on the taximeter. No other fees will be charged to the Customer.
2.12. The Customer can also pay the fare using a credit card or debit card through the App’s payment system (“Online Payment System”). If the Customer chooses to pay for the trip via the Online Payment System, the payment made to TAKSİCİM via the Online Payment System will be deemed to have paid the trip to the Driver, and the Customer will have no obligation to pay the Driver in any other way.
2.13. The Customer enters their credit card or debit card information into the Online Payment System once, and this information is used for subsequent uses without requiring further entry. The Customer may register up to three different cards into the Online Payment System if desired. The Customer is responsible for registering and using their payment information in the Online Payment System.
2.14. In payments made via the Online Payment System, no one other than the credit or debit card holder is responsible for the payment.
In the event of unlawful use by someone else, action will be taken in accordance with the provisions of Law No. 5464 on Banking Cards and Credit Cards, dated February 23, 2006, and the Regulation on Banking Cards and Credit Cards, published in the Official Gazette No. 26458, dated March 10, 2007.

2.15. TAKSİCİM may use the 3D Secure payment option for transaction security.

2.16. At the end of the trip, the Driver enters the amount displayed on the taximeter into the application they use and presses the button to collect payment. For non-cash trips, the payment page will then appear on the Customer’s screen, prompting them to confirm the amount to be paid. The Customer simply presses the “Confirm” button to make payment. By pressing the “Confirm” button and making the payment to TAKSİCİM, the Customer is deemed to have paid the Driver for the trip, and their payment obligation is terminated. Payments made may be reflected in the Customer’s bank account as a single payment or as separate payments where the total payment amount is split into multiple installments, in accordance with the Customer’s banking practices.
2.17. Before clicking the “Confirm” button, the Customer may choose to give the Driver a 10% or 15% tip (“Tip”) with just one touch of a button. In this case, the tip will be automatically calculated by adding it to the amount entered by the Driver and will be collected from the Customer simultaneously with the trip price via the payment method chosen by the Customer. Tipping is entirely dependent on Customer satisfaction and is not mandatory.
2.18. In connection with payments made through the Online Payment System, if the amount on the confirmation screen is incorrect, the Customer may request the Driver to re-enter the trip price by clicking the “Reject” button and the “Amount Incorrect” button.
2.19. In connection with payments made through the Online Payment System, if the credit card currently in use is overdrawn or if the payment cannot be made for any reason, the Customer can make another payment using another credit card they have previously registered with the system, or by registering a new credit card.
2.20. If the payment cannot be made via the Online Payment Method, the Customer is obligated to pay the fee in cash to the Driver.
2.21. The Online Payment System infrastructure is provided by PayTR.
2.22. If the Customer’s smartphone is stolen or lost, card information cannot be accessed by third parties. However, in this case, the Customer must notify TAKSİCİM and request the deletion of the entered information. Otherwise, third parties may continue to make taxi payments using the Application. In such cases, TAKSİCİM cannot be held responsible for payments made through the Application.
2.23. The Customer agrees not to cause any damage to the taxi they take.
2.24. If the Customer leaves any items in the vehicle, they can contact TAKSİCİM customer services; They may request that the Driver be contacted. TAKSİCİM customer services will contact the relevant Driver regarding the forgotten item, and if the Driver confirms that the item is in the vehicle, the Customer and the Driver may exchange contact information, with their permission. The Driver may turn on the taxi meter and take the forgotten item to the Customer’s requested location when delivering it. TAKSİCİM only contacts the parties regarding the forgotten items and the Driver’s delivery to the Customer and shall not be held responsible for any matters other than this.
2.25. The Customer may report any Drivers they have contacted through the App and about whom they have a complaint to TAKSİCİM through the complaints section within the App. In this case, TAKSİCİM will issue the necessary warnings to the Drivers and may terminate the business relationship with any driver who repeats similar errors. However, as the App is a platform designed to bring Customers and Drivers together and to enhance the quality and widespread taxi experience for all parties involved, TAKSİCİM shall not be held responsible under any circumstances for the behavior of the Drivers.
2.26 The Customer agrees not to engage in any action and/or transaction that could exploit the free service provided by TAKSİCİM.
2.27. If it is determined that the Customer has violated the Terms, TAKSİCİM reserves the right to suspend the Customer’s membership or remove them from the Application entirely.
2.28. By using the service offered by TAKSİCİM, the Customer agrees to use the Application in accordance with the law and its intended purpose and to assume legal responsibility for every transaction and action taken within the Application. TAKSİCİM cannot be held directly or indirectly responsible for any transaction, action, and/or activity undertaken by the Customer through and/or within the Application that violates these Terms and the law.
2.29. TAKSİCİM shall not be held liable for the Customer’s inability to use the Service in the Application due to technical malfunctions caused by the Customer, and for any failure to perform any of its obligations set forth in these Terms as a result of such failure, and shall not be liable for any claim under any name.
The Customer agrees that TAKSİCİM cannot be held directly or indirectly responsible for any transactions, actions, and/or activities carried out by the Driver and/or third parties through and/or within the Application, in violation of these Terms and conditions and the law.

2.31. The Customer acknowledges that they are entirely responsible for the security and safekeeping of the system access tools (username, password, etc.) they use to benefit from the services offered by TAKSİCİM through the Application.

2.32. The Customer agrees not to reproduce, copy, distribute, or process any images, text, visual and audio images, video clips, files, databases, catalogs, or lists found within the Application that would constitute an infringement on the real or personal rights or assets of TAKSİCİM and/or any third party.

2.33. TAKSİCİM may offer the Customer the opportunity to benefit from promotions or campaigns from time to time. To benefit from the relevant promotion/campaign, the Customer must comply with the terms and conditions of the relevant promotion/campaign and must not engage in fraudulent behavior (including making fraudulent agreements with Drivers to benefit from the promotion/campaign, making misleading statements, or creating false Customer profiles).
2.34. TAKSİCİM may reclaim, suspend, and/or terminate the Customer’s access to the application if the Customer violates the terms and conditions of the relevant campaign/promotion and/or engages in fraudulent behavior. If the Customer receives a notification from TAKSİCİM to this effect and believes that they have not violated the requirements of Article 2.32, they may appeal the decision by contacting TAKSİCİM Customer Services. 3. TERMINATION
The customer may terminate their TAKSİCİM membership at any time, without giving a reason, by clicking the “Cancel Membership” button in the My Account > My Information > Settings section, or by calling TAKSİCİM customer service at 0850 840 1678. The customer may create up to three new memberships with the mobile number they provided for the cancelled TAKSİCİM membership.
4. PERSONAL DATA PROTECTION

4.2. The customer declares that (i) the information provided in the registration form is accurate; (ii) Only one GSM number can be assigned to each Customer created on TAKSİCİM, (iii) the Customer can change the assigned GSM number from the Menu > My Account > Change Number section, (iv) a new GSM number can only be assigned to a new Customer on the Application, and (v) the Customer is personally responsible for all transactions made with the registered GSM number.
5. OTHER TERMS
5.1. INTELLECTUAL PROPERTY RIGHTS
5.1.1. All elements of the Application, including but not limited to the design, text, images, HTML code, and other codes (“TAKSICİM’s copyrighted works”), belong to TAKSİCİM. The Customer may not use TAKSİCİM’s services, TAKSİCİM’s information, or TAKSİCİM’s copyrighted works for any commercial purpose. Without TAKSİCİM’s express written permission, the Customer may not reproduce, distribute, create, or prepare derivative works from TAKSİCİM’s copyrighted works.
5.1.2. TAKSİCİM reserves all rights to all assets, real and personal rights, commercial information, and know-how, including all material and intellectual property rights it possesses through TAKSİCİM’s services, TAKSİCİM information, TAKSİCİM’s copyrighted works, TAKSİCİM’s trademarks, TAKSİCİM’s commercial appearance, TAKSİCİM’s business model, or the Application.
5.2. AMENDMENTS TO THE AGREEMENT
TAKSSİCİM may, at its sole discretion and unilaterally, amend the Terms at any time it deems appropriate by providing notice through the Application. The amended provisions of the Terms will become effective upon the Customer’s online acceptance through the Application, and the remaining provisions will remain in full force and effect.
5.3. FORCE MAJEURE
In the event of a Force Majeure Event and for the duration of its existence, TAKSİCİM shall not be held liable for any late, incomplete, or non-performance of any of its obligations under these Terms, and no compensation may be claimed from TAKSİCİM under any name whatsoever. The term “force majeure” shall be interpreted as any unavoidable event beyond TAKSİCİM’s reasonable control, including, but not limited to, natural disasters, riots, wars, strikes, communication problems, infrastructure and internet failures, power outages, and adverse weather conditions.
5.4. APPLICABLE LAWAND JURISDICTION
Turkish Law shall apply to the application, interpretation, and legal relationships arising under these Terms. Istanbul Central Courts and Enforcement Offices shall have jurisdiction in the event of any dispute arising or that may arise under and/or in connection with these Terms.
5.5. TERMINATION OF THE AGREEMENT
These Terms shall remain in force until the Customer’s membership terminates and shall continue to have its provisions and consequences between the Parties. TAKSİCİM may unilaterally terminate the Terms if the Customer violates the provisions set forth in these Terms or the rules and conditions contained in the Application.
5.6. VALIDITY OF TAKSİCİM’S RECORDS
The Customer acknowledges that, in disputes that may arise under these Terms, the electronic records and system records, commercial records, ledger records, microfilm, microfiche, and computer records kept by TAKSİCİM on its database or servers shall constitute valid, binding, definitive, and exclusive evidence; that it absolves TAKSİCİM of any oath-taking requirement; and that this provision constitutes an evidentiary contract within the meaning of Article 193 of the Civil Procedure Code.
5.7. ENFORCEMENT
This Agreement has been mutually accepted and entered into force upon the Customer’s electronic approval.
